This Policy does not apply to employees, job applicants, or non-employee workers. It also does not apply to websites, apps, products, or services that we do not own or control.

  • Gifting Information: Details provided for gift orders, including recipient information (subject to compliance requirements).

Use of Personal Information

We use personal information for the following purposes:

  • SMS Abandoned Cart: Our Website uses cookies and plugins to track shopping cart activity, including when carts are abandoned. This data may be used to send reminder messages via SMS if you have opted in.

  • Advertising and Audience Matching: Creating and managing custom and similar audience segments on third-party advertising platforms; delivering relevant ads to you on those platforms and across the internet; excluding existing customers from certain campaigns; and measuring advertising performance. Contact information used for this purpose is hashed before it is shared. See Advertising Partners and Customer Match below.

  • Personalization: Tailoring content, offers, and experiences to your preferences.

  • Analytics & Improvements: Evaluating and improving our Platform, products, and services.

  • Legal & Compliance: Age verification, fraud prevention, state shipping restrictions, and compliance with alcohol sales regulations.

  • Business Operations: Recordkeeping, audits, legal compliance, security, and corporate transactions.

SMS and Email Marketing Compliance

  • Consent: We will only send you SMS/text messages or promotional emails if you explicitly opt in. By providing your mobile number or email and opting in, you agree to receive recurring communications. Standard message and data rates may apply.

  • Opt-Out:

    • SMS: Reply "STOP" to any SMS we send. You will receive a confirmation of your opt-out.

    • Email: Click "Unsubscribe" at the bottom of any marketing email.

    • Transactional messages (e.g., order confirmations, shipping updates) are not subject to opt-out, as they are necessary to fulfill your purchase.

  • Data Use: SMS opt-in consent records and unsubscribe requests are securely maintained as required by law.

  • Third-Party Sharing: No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. SMS/text message originator opt-in data and consent are excluded from all sharing described in this Policy and will not be shared with any third parties, including advertising platforms.

Advertising Partners and Customer Match

We share customer data with third parties who perform advertising and marketing services on our behalf. Where required by law or by the policies of the platforms we use, we obtain your consent before sharing your data for these purposes.

What we share. We may provide advertising platforms with contact information such as your email address, first and last name, mailing address, country, and zip code. Before this information leaves our systems, it is hashed using a one-way cryptographic function (SHA-256), so the platform receives an irreversible code rather than your information in readable form.

Why we share it. Advertising platforms use this hashed data solely to match you to an existing account on their service so that we can show you relevant advertisements, avoid showing you ads for products you have already purchased, reach audiences with characteristics similar to our customers, and confirm that our campaigns comply with platform policies. Data that does not match is not retained by the platform for other uses.

Google Customer Match. We participate in Google's Customer Match program. Data uploaded to Google is used only to match our customers to Google accounts and to ensure our campaigns comply with Google's policies. Google's use of this data is governed by the Google Customer Match policies and, where the General Data Protection Regulation applies, by the Google Ads Data Processing Terms, under which Google acts as a data processor on our behalf. We share this data in compliance with those policies and with Google's EU user consent policy.

What we do not share. We do not sell your personal information for money. We do not share SMS/text message originator opt-in data, consent records, or mobile phone numbers with advertising platforms. We do not share detailed alcohol purchase histories, age verification documentation, payment card data, or government-issued identification with advertising platforms.

Contractual protections. Advertising partners act as our service providers or processors. They are contractually prohibited from using the information we provide for their own independent purposes, from disclosing it outside the scope of their services to us, and from combining it with other data except as permitted under their agreement with us.

Your choices. You can ask us to remove you from our advertising audiences at any time by emailing info@harvestwineshopsd.com with the subject line "Advertising Opt-Out." You may also manage the ads you see from Google directly through Google My Ad Center. Opting out of advertising cookies on our Website does not automatically remove you from customer lists that have already been shared, so please contact us directly if you want your information removed.

Disclosure of Personal Information

We may share information with:

  • Our corporate affiliates and subsidiaries.

  • Service providers who perform services on our behalf, such as payment processing, shipping, marketing, advertising, audience matching, analytics, customer support, and security. These third parties are permitted to use the information only to provide services to us.

Important: SMS/text message opt-in data, consent records, and mobile phone numbers will never be shared with or sold to third parties for marketing or promotional purposes.

Cookies and Tracking

We and our service providers use cookies, pixels, and other tracking technologies for:

Beyond Cookies: Some of our advertising activity does not rely on cookies. As described in Advertising Partners and Customer Match, we also share hashed contact information directly with advertising platforms. Location Tracking and Location-Based Services

If you use our mobile app or services requiring location data, we may collect and use this information to:

Our sharing of hashed contact information with advertising platforms may be considered "sharing for cross-context behavioral advertising" or a "sale" under some state privacy laws, even though we receive no money for it. You may opt out at any time using the methods described under Your Rights and Choices above. We will not discriminate against you for exercising any of these rights.

Users in the European Economic Area, United Kingdom, and Switzerland

We do not currently ship outside the United States and our Services are not directed to individuals located in the EEA, UK, or Switzerland. If you access our Website from one of these regions, we process your personal information on the following legal bases: performance of a contract (to fulfill orders and provide customer support), compliance with legal obligations (age verification and alcohol regulations), our legitimate interests (site security, fraud prevention, and improving our Services), and your consent.

Where the General Data Protection Regulation or UK GDPR applies, we will not place non-essential cookies, send marketing communications, or share your data with advertising platforms for personalized advertising without first obtaining your consent, consistent with Google's EU user consent policy. Alcohol Sales Compliance Addendum

Harvest Wine Shop is legally required to comply with all federal and state alcohol regulations. This includes strict age verification, shipping restrictions, and record-keeping requirements. By purchasing from us, you agree to the following:

Age Verification and Purchase Requirements

  • You must be 21 years of age or older to purchase alcohol.

  • We verify age using government-issued identification, third-party verification services, and date-of-birth checks at account creation and checkout.

  • An adult signature (21+) is required for all deliveries.

  • Age verification data is retained for a minimum of 3 years as required by law.

  • Purchases from other states will be rejected.

  • Deliveries require:

    • Shipping to residential or business addresses only (no P.O. boxes, APO/FPO).

    • Billing and shipping addresses must match unless approved for gift orders.
