2.1 Shipping Restrictions

We currently only ship to the following states: California (CA), Connecticut (CT), Florida (FL), Louisiana (LA), Nebraska (NE), New Hampshire (NH), New Mexico (NM), North Dakota (ND), Oregon (OR), Virginia (VA), and West Virginia (WV). By placing an order, you acknowledge and agree that:

  • Orders from non-approved states will be automatically canceled

  • State shipping permissions are subject to change without notice

  • Volume limitations may apply based on state law

  • We reserve the right to refuse shipping to any address

2.2 Delivery Requirements

All deliveries are subject to the following conditions:

  • Adult signature (21+) required for all deliveries

  • Valid government-issued photo ID must be presented

  • No delivery to P.O. boxes or APO/FPO addresses

  • No delivery to business addresses that cannot accept alcohol

  • Shipping address must match billing address unless approved for gift orders

  • Three failed delivery attempts will result in order cancellation and return

  • Weather holds may be implemented to protect product quality

3.1 Wine Products

You acknowledge and agree that:

  • Vintage substitutions may occur if advertised vintage becomes unavailable

  • Wine is a natural product and variations in color, taste, and sediment are normal

  • Cork condition is not guaranteed due to natural variation

  • Labels may show signs of age or cellar conditions

  • Storage recommendations should be followed to maintain quality

  • Temperature fluctuations during shipping may affect wine quality

  • Product images are representative and may not reflect exact label condition

3.2 Returns and Refunds

Our return policy is limited to:

  • Incorrect products shipped

  • Damaged products (must be reported within 24 hours of delivery)

  • Spoiled or tainted wine (must be reported within 48 hours of delivery)

No returns are accepted for:

  • Properly delivered, undamaged products

  • Wine storage or handling issues after delivery

  • Personal taste preferences

  • Vintage variations when substitution was approved

  • Weather holds may be implemented to protect product quality

  • Shipping delays may occur due to temperature extremes or carrier disruptions

  • Alternative delivery arrangements may be required

  • Storage requirements may be imposed during extreme conditions

SECTION 14 - DISPUTE RESOLUTION

14.1 Initial Resolution

For any dispute, claim, or controversy arising out of or relating to these Terms or the purchase of wine products, we agree to:

  • Gift cards expire two (2) years from the date of purchase

  • Lost or stolen gift cards should be reported to info@harvestwineshopsd.com for replacement

  • Gift card balances cannot be exchanged for cash

  • We are not responsible for unauthorized use of gift cards

  • Gift cards cannot be used to purchase additional gift cards

22.2 Gift Card Terms

  • Gift cards must be redeemed through our website

  • Multiple gift cards may be used on a single order

  • Remaining balances will be stored for future use until expiration

  • Gift card purchases are final and non-refundable

  • Gift cards cannot be resold or transferred for value
